2. Data Processing for Website Hosting and Application Platform

A. Application Platform Hosting with Microsoft Azure

Our core application platform (where customer data might be processed when using our services) is hosted using Microsoft Azure services provided by Microsoft Corporation (One Microsoft Way, Redmond, WA 98052-6399, USA), ("Microsoft").

Microsoft acts as our Data Processor. We configure our Azure services to utilize data centers located within the European Union (Germany/EU region) wherever feasible and technically possible for the specific services used.

When you use our application platform, technical data necessary for its operation (which may include personal data depending on your usage) is processed by Microsoft Azure.

The legal basis for this processing is typically the performance of a contract (Art. 6 (1) (b) GDPR) when you use our paid services, or our Legitimate Interest (Art. 6 (1) (f) GDPR) in providing a secure and functional platform.

We have concluded a Data Processing Agreement (DPA) with Microsoft in accordance with Art. 28 GDPR.

B. Website Hosting with IONOS

Our public website (www.ceel.ai) is hosted by IONOS SE (Elgendorfer Str. 57, 56410 Montabaur, Germany), ("IONOS").

IONOS acts as our Data Processor. We have configured our hosting services with IONOS to ensure that website server log files are processed and stored exclusively in data centers located within the European Union (Germany).

Server Log Files:
When you visit our website, IONOS automatically collects and stores information in "server log files." This data typically includes browser type and version, operating system used, referrer URL (the page you came from), time of the server request, and your IP address (stored in anonymized form after 7 days).

Legal Basis:
The legal basis for this processing is our Legitimate Interest (Art. 6 (1) (f) GDPR) in the secure, stable, and performant delivery of our website.

Data Processing Agreement:
We have concluded a Data Processing Agreement (DPA / AVV) with IONOS in accordance with Art. 28 GDPR.

C. Content Delivery Network (CDN) & Security via Cloudflare

We use the services of Cloudflare, Inc. (101 Townsend St., San Francisco, CA 94107, USA), ("Cloudflare") as a Content Delivery Network (CDN) and Web Application Firewall (WAF) to optimize loading speed and protect against attacks for both our website and application platform. This includes Cloudflare Turnstile, a privacy-friendly CAPTCHA alternative used to verify human users and prevent bot-driven attacks.

To provide this service, Cloudflare must process the IP address of the visitor. The legal basis for this is our Legitimate Interest (Art. 6 (1) (f) GDPR).

D. Third-Country Data Transfers (USA - Microsoft, Cloudflare, Google)

Microsoft, Cloudflare, and Google (used for analytics as described below) are US-based companies. This means data (including technical data like IP addresses or analytics data) processed by these services may be transferred to the USA, a "third country" without an adequate level of data protection equivalent to the EU.

We have based these data transfers on the EU-US Data Privacy Framework (DPF) (to which Microsoft, Cloudflare, and Google are certified) and by concluding Standard Contractual Clauses (SCCs) with these providers where applicable.

3. Cookies, Consent Management, and Web Analysis

A. Use of Cookies and Consent Management

Our website uses "Cookies." Cookies are small text files that are stored on your device and do not cause any harm.

We differentiate between two types of cookies:

Essential Cookies:
These are technically necessary to provide the basic functions of the website. The legal basis for the use of Essential Cookies is our Legitimate Interest (Art. 6 (1) (f) GDPR) in providing a functioning website.

Non-Essential Cookies (e.g., Analytics):
These are used for analysis, marketing, or other non-essential purposes. The legal basis for the use of all Non-Essential Cookies (including those for Google Analytics) is your explicit Consent (Art. 6 (1) (a) GDPR). These tools will only be activated if you provide your consent.

Consent Management:
We use a Consent Management solution (a "Cookie Banner," managed via Google Tag Manager) to request your consent before setting any non-essential cookies. You can revoke or change your cookie consent at any time via the "Cookie Settings" link in our website's footer.

B. Google Analytics 4 (with IP Anonymization)

This website uses Google Analytics 4 (Measurement ID: G-0VY01Z4MBC), a web analysis service provided by Google. The provider for users in the EU is Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland), but the data is ultimately processed by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA), ("Google").

Implementation via Google Tag Manager: We implement Google Analytics through Google Tag Manager (GTM) with Google Consent Mode v2. This ensures that analytics data is only collected when you have provided explicit consent via our Cookie Banner.

Legal Basis: This service is used exclusively on the basis of your Consent (Art. 6 (1) (a) GDPR), which you provide via our Cookie Banner (powered by Klaro!).

IP Anonymization: We have activated the "IP Anonymization" feature for Google Analytics 4. This means your IP address will be anonymized (truncated/shortened) by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area before any data storage or processing occurs. This privacy safeguard is implemented automatically in our GA4 configuration.

Consent Management: You can withdraw your consent at any time by clicking the "Cookie Settings" link in our website footer, which allows you to review and modify your cookie preferences.

Data Processing Agreement (DPA): We have concluded a DPA with Google in accordance with Art. 28 GDPR.

4. Contacting Us

When you contact us via general email (e.g., to [email protected]) or a contact form, the personal data you transmit (e.g., your name, email address, and inquiry) will be processed to handle your request.

The legal basis for this processing is either Art. 6 (1) (b) GDPR (if your inquiry is related to a contract) or our Legitimate Interest (Art. 6 (1) (f) GDPR) in effectively processing general inquiries.

Your data will be deleted after your request has been finally processed, provided no statutory retention obligations apply.
